What Does the Charitable Donation Extension Mean for Tax Planning?

The extension to February 28, 2025, may create additional planning opportunities for donors.

In response to widespread Canada Post service disruptions that hampered year-end charitable giving, the Government of Canada proposed an extension to the 2024 charitable donation deadline to February 28, 2025; the same date as the 2024 RRSP contribution deadline. The extension aims to give Canadians more flexibility in their charitable giving while preserving tax advantages for the 2024 tax year.

While Parliament was expected to formalize this extension in early 2025, its recent prorogation until March 24 has delayed the legislative process, making the extension uncertain.

For donors considering charitable contributions in early 2025, tax planning options remain available regardless of the extension's fate. Donations made in January and February can still be claimed on 2025 tax returns or carried forward, ensuring that charitable tax credits are preserved even if the retroactive extension doesn't materialize.

The potential extension could offer valuable opportunities for strategic charitable giving through vehicles like the Nicola Wealth Private Giving Foundation (NWPGF) and Donor Advised Funds (DAFs), particularly for those planning significant donations or complex giving arrangements.

What This Means for Donors

In regular years, donations must be made by December 31 to qualify for same calendar year tax credits. In 2024, donors will receive a special provision for an additional two months, pending legislative approval.

We anticipate that similar to RRSPs, donations made between January 1, 2025 - February 28, 2025 can be applied to either the 2024 or 2025 tax year.

Key benefits of this extension include:

  • Opportunity to optimize the timing of donations based on income levels and other tax considerations across 2024 and 2025
  • Greater flexibility in managing cash flow while maintaining philanthropic commitments
  • Enhanced ability to align charitable giving with overall tax strategies by having additional planning time

Strategic Planning Considerations

While the proposed extended timeline may provide additional flexibility, these benefits reflect broader advantages of charitable giving and several strategic planning opportunities, including:

Securities Donation Optimization

  • Donate appreciated securities “in-kind” directly to a Donor Advised Fund to receive a donation tax credit for the full market value and avoid realizing any capital gains tax on the appreciation
  • Take advantage of the additional time to select the most tax-efficient assets for donation

Income Timing Considerations

  • Align contributions with high-income years or liquidity events
  • Use the flexibility of a Donor Advised Fund to maintain consistent charitable impact regardless of income fluctuations
  • Coordinate tax-loss selling with Foundation contributions to optimize tax efficiency

The Nicola Wealth Private Giving Foundation: Strategic Charitable  Giving through Donor Advised Funds

For those motivated to give but seeking flexibility in their charitable decisions, the NWPGF offers a powerful mechanism through Donor Advised Funds. This option is particularly valuable for clients planning to give $25,000 or more who would like to claim the tax benefits now but may not yet have fully fleshed out a giving strategy.

Features of DAFs include:

Tax Benefits and Flexible Giving

  • Donate cash and/or shares in-kind and receive your tax receipt immediately upon receipt of the donation
  • Receive a tax receipt when you contribute to the Donor Advised Fund (not when a charity receives the funds), streamlining your charitable gifts while providing flexibility to distribute to charities over time
  • For charities that cannot accept donations of shares in-kind, the Donor Advised Fund serves as an intermediary, enabling the donation and potentially preserving the associated tax benefits
